What rights do collection agencies have regarding automatic withdrawls from a checking account?

One of my debts from a few years ago has been turned over to a collection agency. They contacted me and I was very cooperative about agreeing to have a set amount withdrawn from my checking account each pay day. This was set up approximately 6 months ago and it has since reduced this debt by about one-fourth of the original amount. Suddenly, I began receiving almost daily phone messages from the agency demanding that I get in touch with them (I know that they want me to either increase my payment amount or work out a settlement, neither of which I am able to do at this time). I sent them a letter explaining that I cannot change anything at present, but am willing to keep up our current agreement until things change. Now I see that they have *not* withdrawn the agreed upon amount from my account after this last paycheck. What are they up to? Do they have any right to take action against me when I have been cooperative and have made regular payments for half a year?

Collection agencies have no rights regarding automatic withdrawals. They only have the rights you give them. If they have your checking account number and you don’t want them to do auto withdrawals from your account, then close the account AT ONCE. They will keep withdrawing money if they can, even if you don’t want them too, and the bank can’t really stop them because they can only stop a certain amount set to withdraw on a certain date. Also, they can’t sue you for money because they are not the original lenders. And if they did try to, the judge would be on your side since you are making payments. Also, in the State of California, if a collection company harrasses you, you can sue them for 3 times the amount you owe them for harrassment. If you tell them you don’t want them to call you ever again, they can’t, and it would be harrassment if they did. They can only send you letters.

Now, if this collection company really has your debt, they want to settle with you. Basically, they will settle for as little as 30% of what you owe. So, if you owe $1,000, they may take $300 and write this account off completely. That means they cannot send it to another collection company. Plus, if they are going to settle with you, they will have to do it in 3 monthly payments, so that $300 would be $100 a month. They can’t do more than 3 monthly payments on an agreed upon amount. (No one can, which is why infomercials always offer 3 monthly payments and not 4 or 5.)

The only thing I would suggest if you do settle with them, is GET IT IN WRITING BEFORE THEY WITHDRAW MONEY. I settled with all my credit cards years ago, and one company did not give me the information in writing…so ten years later, I still had a collection company trying to tell me I owed them money and I had no letter to prove I didn’t. So, get that letter and keep it in a handy place…and if I were you…I’d call them just to see what they are offering.
